If the truth be told, this case should have ended years ago.
Magistrate Feresi Chakanyuka, who initially handled the matter, was supposed to finalise it before her elevation to the High Court. That is how the system is supposed to work, continuity, conclusion, accountability.
Instead, Marry Mubaiwa was subjected to the cruelty of wasting 7 years& then a new presiding officer, new dates, and the same absent complainant. The result is not just injustice but a massive waste of state resources for a single charge that the State would not prove.
Hapana politics dziripo when one drags a person to court and yet refuses to attend the same court to testify for 7 years. That's just being cruel!

VP Chiwenga walked away from cross-examination in camera years ago and never returned to the dock. In any other case in Zimbabwe, without a complainant, the case would have collapsed in months. The charge would have been withdrawn and the accused freed.
Yet for years the complainant refused to testify and kept his former wife, disabled, wheelchair-bound, on remand in legal limbo. He believed he was above the law, that the court would wait for him indefinitely.
His former wife suffered financially, physically, mentally, while the court waited. That is absolutely wrong. It is the definition of being above the law.
Now, if one behaves like that with half-power, what does it mean where they to get all the power? Tinopera teseka!
The true essence of being a leader is to have a good heart, and that is most apparent from how you relate with people within your vicinity. Not from speeches and slogans.
It is also sad how the women of Zimbabwe failed to stand up for one of their own. To even allow political tones to come into this matter is itself evil because there are none such. There is no politics here. There is only a hard heart that refused to yield to humanity
